The client understands that upon booking, I am committing time and resources to their event/service and thus cancellation would result in lost income and lost business opportunities in an amount difficult to precisely calculate. Therefore, the following cancellation limitations and other limitations will apply:
 

COVID-19/SICKNESS ASSUMPTION OF RISK

Clients who book with me acknowledge and understand the following: (1) Participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; (2) knowingly and freely assume all such risks related to illness and infectious diseases, such as COVID-19, even if arising from the negligence or fault of the Released Parties; and (3) hereby knowingly assume the risk of injury, harm and loss associated with the activity, including any injury, harm and loss caused by the negligence, fault or conduct of any kind on the part of the Released Parties.

 

For the safety of myself, my studio and future clients: clients who book + come to the studio for a photography session should have a body temperature no higher than 98.6°F / 37.5°C. Clients nor persons whom they bring with them to the sessions must not be experiencing any symptoms of fever, cough, sore throat or any other flu like symptoms. Clients also must not have been in contact with a COVID-19 patient within the last 14 days prior to their session. Upon booking, clients declare that the above declarations are accurate. The following sick policy is in place to ensure protection of both Ava + Otis Designs clients as well as my own family: Anyone presenting the following symptoms will be asked NOT to come to the studio and reschedule for AT LEAST five days after symptoms end: barking cough, vomiting, diarrhea, fever, rash, spots near hands, feet or mouth, runny nose, or any other symptom of a communicable disease that spreads easily. If a client comes to the studio with these symptoms despite the policy in place, I reserve the right to ask you to leave and you will forfeit your session fee. As a family and baby photographer, I work with very fragile clients and it is my number one priority to protect them from the unnecessary spread of germs. 

BOOKING POLICIES

The mandatory booking retainer for Photography Sessions is nonrefundable. Dates/session times are only reserved and guaranteed after the non-refundable booking retainer is paid. I will not begin the photoshoot until the session is paid for in full. Clients who would like to pay cash still have to pay the nonrefundable booking retainer online to secure their session date and time. I do not give any unedited images or files to the client. Clients may post the photos they have received and/or paid for from their session but ask that the client tag my business for credit. I own the rights to all photos taken by my camera/phone/Go-Pro and other devices I use for my business. Personal use of DSLR cameras or other professional equipment during sessions by the client are NOT permitted and will not be tolerated. This includes GoPro's, tripods and other professional camera equipment. Cell phones are permitted for personal use behind-the-scenes but are not to intervene or interrupt me during the sessions.

For newborns and/or babies who are still in diapers, I will not do any photos of babies without their diaper. I will not permit any poses that I feel are unnatural or unsafe for the baby. I do not do any poses where a baby is suspended from a prop. Regarding cake smash sessions, client's may bring their own desserts, cakes or food items to be photographed in the session. However, this will not change the price of the session. I am not responsible for any children and/or adults that do not wish to participate and/or cooperate during a session. I am not responsible for any injuries nor damages to personal property or belongings during sessions. If a session, whether indoor or outdoor, cannot take place due to extreme weather conditions such as extremely high temperatures or unexpected storms, photographer and client will reschedule on an agreed upon date with no additional charge. Client's may reschedule within a week for personal reasons, if need be, without having to re-pay the deposit. After a week without a reschedule, clients will have to repay the deposit and remaining balance to schedule another session.

I will allow a thirty-minute grace period for a client to show up to their session. After the thirty-minutes, I will consider a client a no-show, the session will be terminated, and the client will need to reschedule.  This is a binding agreement. Any retainer and/or fees paid by the client are considered earned upon paying the invoice and no amounts paid by the client will be refunded, even if the client cancels, is a no-show or postpones the session or changes the date or time of the session. 
 

Client's may purchase additional digital files from their session, if desired. Photo packages must be chosen within 30 days of the client receiving their personalized gallery. Photo package options may not be exchanged, combined nor refunded. All sales are final. If applicable, some galleries may contain examples of personalized stationery items. These items are not included in the photo package and must be purchased separately from the photos - whether as a digital or printed stationery item. After the 30 days, the photos may no longer be available to the client(s). Clients may regain access to their galleries if they pay an unarchiving fee of $50.00. After three months, photos will be deleted. I am not responsible for loss of photos after the 30 days nor after a client purchases + downloads their digital files.

 

Various photo-packages are available and will be discussed after the session with the client. Amount of photos given in the final gallery may vary. At this time, my turnaround time for photos is between a 1.5 - 2.5 weeks after your session date, excluding days the studio is closed and holidays. All photos will be edited. No unedited files are given to the client. Prices are subject to change. 

 

All other services that are paid for in full on the website such as stationery items, custom piñatas and memory boxes are not subject to refunds, as clients have had to approve of these items during the creation process and before they are shipped out. Once these items are shipped, I am not responsible for any damages occurred during shipping.
 

Above all, I have the right to refuse service to anyone who does not agree to my policies.
